Client Contract

1. Agreement: This agreement constitutes a binding contract for photography services and/or products. By signing this Agreement

the Client agrees to pay K. Reinholz Photography at the price agreed upon for services and/or products.

 

2. Cooperation, Exclusivity and Guest Photography: It is understood that K. Reinholz Photography is the exclusive photographer retained by the Client for this event. No other cameras are to be allowed to take photographs at event for any reason other than non-commercial usage. If persons inhibit K. Reinholz Photography from performing the services covered by the Contract, the Client will be asked to remove said persons so K. Reinholz Photography can continue working without distraction. Client is also responsible for reserving any venue and/or obtaining necessary permissions, if need be, prior to date of services. K. Reinholz Photography is granted full editorial, production and content control by the Client regarding all aspects of production. K. Reinholz Photography is not responsible for shots missed or omitted because the photographer was being blocked, distracted or any other means out of K. Reinholz Photography's control.

 

3. Termination and Cancellation: K. Reinholz Photography will not be liable to Client under any circumstances if services cannot be performed because of, but not limited to, acts of God, adverse weather conditions, photographer unavailability, photographer illness, photographer medical/personal emergencies and any circumstances deemed unavoidable by K. Reinholz Photography. Client will need to inform K. Reinholz Photography 7 (seven) days in advance if a session, excluding weddings, needs to be rescheduled/cancelled. If a session is rescheduled the Client may be subject to a $50.00 rescheduling fee. If inclement weather prohibits an outdoor session from taking place, it is the Client's responsibility to have another venue serve as a back-up location. It is also at K. Reinholz Photography's professional discretion to cancel an outdoor if deemed necessary.

 

4. Delivery and Copyrights: Within 2 (two) to 4 (four) weeks of event date, excluding weddings, digital photographs will be complete. K. Reinholz Photography owns all rights to the photographs and will use them for professional/portfolio matters. Boudoir photographs will be used for professional/portfolio matters unless the photographs are deemed by K. Reinholz Photography, in its sole discretion, to be of an intimate nature, in which case K. Reinholz Photography will use the photos only with the consent of the Client. K. Reinholz Photography grants the Client permission to share images on social networking websites, with family and friends, and on vendor websites as long as the images remain unaltered and textual credit is explicitly given to K. Reinholz Photography.

 

5. Additional Fees: Any additional fees are not K. Reinholz Photography's responsibility. Things such as, but not limited to, admission, parking, hotel rentals, etc. are not covered in the cost of your package. They are strictly the sole responsibility of the Client. Payment for sessions, excluding weddings, will be expected at time of service. It is also understood by Client that all package pricing is as-is. Any additional time, materials, travel, prints, albums, etc. will be at an additional cost to the Client. Re-touching of images is limited to 5 (five) images and must be requested within 30 (thirty) days of the postmarked disc. Anything surpassing the alloted 5 (five) images or the 30 (thirty) day window of time will be at K. Reinholz’s discretion and all additional costs will be Client responsibility.

 

The parties agree that the total liability, in the aggregate, of K. Reinholz to Client for any and all claims, losses, costs or damages, including attorneys’ fees and costs and expert-witness fees and costs of any nature whatsoever or claims expenses resulting from or in any way related to the photographer’s work or this agreement from any cause or causes shall not exceed the total compensation received by K. Reinholz under this agreement. It is intended that this limitation apply to any and all liability or cause of action however alleged or arising, unless otherwise prohibited by law. The parties agreement that neither the Photographer nor Customer shall be liable to the other or shall make any claim for any incidental, indirect or consequential damages arising out of or connect in any way to the work to be performed under this agreement. This mutual waiver of consequential damages shall include, but is not limited to, loss of reputation and any other consequential damages either party may have incurred from any cause of action including negligence, strict liability, breach of contract and breach of strict or implied warranty.

K. Reinholz Photography reserves all rights to update/modify any pricing, terms and conditions, or contract information without notice to Client.
